Ind. financier gets 50 years for $200m swindle

INDIANAPOLIS (AP) ? An Indiana financier and former chief executive of National Lampoon convicted of swindling investors out of about $200 million was sentenced Friday to 50 years in prison by a judge who told him his "deceit, greed and arrogance" had cost many of his victims their life savings and dreams of a comfortable retirement.

U.S. District Judge Jane Magnus-Stinson said Timothy Durham had violated the trust of thousands of small investors from the American Heartland who had been careful with their money and invested it with him in hopes of traveling in their retirement, paying off their mortgages and perhaps buying a small home in Florida.

She told the court Durham had plundered their money so he could live a luxurious lifestyle.

"We drive Chevys and Buicks and Ford, not Ducatis. That's how most of us roll," Magnus-Stinson said. "When they're defrauded, it is the most serious offense because it undermines the fabric of this country."

Durham said he felt "badly" for all the families who lost their savings, but never admitted any wrongdoing.

"Of course I feel terrible they lost all their money. My family has lost all of its investments," he said. "I feel very badly for all the people, especially the people here today."

Durham, who was led into the courtroom in handcuffs and leg chains and wearing a gray-green prison jumpsuit, had no visible reaction when the judge pronounced his sentence. The 50-year-old rocked briefly in his chair afterward and fidgeted with a pen he held with his both his hands, quietly telling Magnus-Stinson "No, your honor" when she asked if he had any questions about his sentence.

But he appeared dazed as he was handcuffed and led from the room into the custody of the U.S. Marshals Service.

John Tompkins, Durham's lawyer, did not immediately return a call for comment after the sentencing.

James Cochran, an associate of Durham, was sentenced Friday to 25 years in prison, while accountant Rick Snow received a 10-year sentence. Both Durham and Cochran were taken away in handcuffs to serve their sentences, but Snow was allowed to leave with his family, pending a determination on where he will serve his sentence.

A jury in June found the three men guilty of securities fraud and conspiracy. It also convicted Durham, a major Indiana Republican Party donor who resigned his post at National Lampoon in January, of 10 counts of wire fraud, while Cochran and Snow were convicted on some of those counts.

Prosecutors have said the three stripped Akron, Ohio-based Fair Finance of its assets and used the money to buy mansions, classic cars and other luxury items and to keep another of Durham's company afloat. The men were convicted of operating an elaborate Ponzi scheme to hide the company's depleted condition from regulators and investors, many of whom were elderly.

Tompkins argued at trial that Durham and the others were caught off-guard by the economic crisis of 2008, and bewildered when regulators placed them under more strict scrutiny and investors made a run on the company.

The charges against Durham led several GOP politicians, including Indiana Gov. Mitch Daniels, to return hundreds of thousands of dollars in campaign contributions sought by Fair Finance's bankruptcy trustee.

Attorneys for all three men had asked the judge for lighter sentences than those recommended. Prosecutors had wanted 225 years for Durham, and Tompkins sought a total of five years ? three years in prison and two years of home detention.

Magnus-Stinson said she couldn't give Durham the maximum sentence because it would be as "puffed up" as statements that he held $280 million in assets. But she noted that though he testified that he "felt terribly" for the victims, he had shown no sincere remorse.

Magnus-Stinson said she was unmoved by testimony about Durham's generosity over the years, including giving to charities and also to political campaigns.

"It's very easy to be generous if you're using someone else's money ? and that's what was happening here," she said.

U.S. Attorney for the Southern District of Indiana, Joe Hogsett, said Friday's sentencing means families can finally begin putting their lives back together.

Barbara Lukacik, 74, an Ohio nun who said she lost $125,000 in the Fair Finance collapse, said she had forgiven Durham and the others but testified before the sentencing that a lengthy sentence was warranted.

"If you receive a short sentence ? a slap on the wrist, so to say ? I do not think it will be enough time for your heart and your conscience to realize your sin and your greed," she said.

Jane Kalina of Wayne County, Ohio, testified Friday that her 86-year-old father lost more than $170,000 ? some of it from the sale of a family farm ? that he had invested.

She said after the sentencing that she was satisfied, and was particularly pleased by Durham's lengthy sentence.

"I think he was the culprit and the sentence fits the crime," she said. "We're happy that he will be very old when he gets out."

First success of targeted therapy in most common genetic subtype of non-small cell lung cancer

ScienceDaily (Nov. 28, 2012) ? A new study by an international team of investigators led by Dana-Farber Cancer Institute scientists is the first to demonstrate that chemotherapy and a new, targeted therapy work better in combination than chemotherapy alone in treating patients with the most common genetic subtype of lung cancer.

Published online November 28 in The Lancet Oncology, the combination of chemotherapy and the targeted drug selumetinib was more effective than chemotherapy alone in a clinical trial involving patients with a form of non-small cell lung cancer (NSCLC) that carries a mutation in the gene KRAS -- a variety that represents about 20 percent of all NSCLC cases. Previously, no targeted agent, either alone or in combination with another drug, had proven beneficial in a trial involving patients with this type of NSCLC.

The 87 patients who participated in the new, phase II trial -- conducted at 67 sites around the world -- had advanced, KRAS-mutant NSCLC that had failed initial chemotherapy. The participants were randomly assigned to receive either selumetinib and the chemotherapy agent docetaxel or docetaxel alone.

Investigators found that while 37 percent of the patients in the selumetinib group experienced some shrinkage of their tumor, none of the patients in the docetaxel-only group did. Of particular significance, patients receiving selumetinib lived a median of 5.3 months before their cancer began to worsen, compared to 2.1 months for those receiving chemotherapy alone. (Patients in the selumetinib group also survived longer, on average, than those in the docetaxel group -- 9.4 months compared to 5.2 months -- but the improvement was not considered statistically significant.)

"Our findings suggest that selumetinib and docetaxel work synergistically -- each enhancing the effect of the other," says the study's lead author, Pasi A. J?nne, MD, PhD, of Dana-Farber. "This opens the possibility that there may finally be a therapeutic strategy using a targeted therapy which could be clinically effective in this population of KRAS-mutant lung cancer patients."

Some side effects, including neutropenia (a white blood cell deficiency), neuropenia plus fever, shortness of breath, and loss of strength, were more common in the selumetinib group than the other. Researchers and physicians will need to work on ways of managing these problems with patients, J?nne said.

NSCLC tumors with KRAS mutations are more common in current and former smokers than in those who have never smoked, and occur at a higher rate in Caucasians than in others. The study findings are especially noteworthy because mutated KRAS -- regardless of the type of tumor it appears in -- has been one of the most difficult genes to block with targeted therapies.

Selumetinib circumvents that problem by targeting not KRAS itself, but one of the gene's co-conspirators, a protein called MEK that is indirectly activated by KRAS.

"The opportunity now is to validate this approach in further clinical trials so it can be developed into a real therapy for patients," J?nne remarks. "Given that KRAS mutations are common in other cancers (found in 90 percent of pancreatic cancers and 40 percent of colon cancers), our findings may be useful in developing therapies for patients with these cancers as well."

I had to admit that it seemed odd to be discussing managing existing systems rather than the latest and greatest thing since sliced bread -- a RSNA hallmark.

?We have customers who want to replace systems because they?ve gotten old, we have customers who want to add options to their current systems -- they have different ways they want to maximize their systems,? said Duffy. ?It?s really about rather than selling them something, asking them what?s your plan? So we offer something we call a Customer Development Session. We use econometrics to examine the lay of the geographic area with population, institutions and outlook for disease. We also offer utilization management that examines the type of exams being done and their frequency. So we can use how the customer uses his assets and what the demand might be.

?The third component is what the customer wants to do, what their mission may be to add programs or whatever,? she continued. ?What comes out in the end is an asset management plan, usually a three- to five-year plan. And we offer this for free. But it isn?t Siemens trying to sell something necessarily; it can mean combining systems, eliminating assets or replacing one. When something changes in the reimbursement landscape, like Obamacare, people now are assessing whether they have the right mix of systems and do I need to upgrade. It?s also not just capability of systems, it?s staffing. You want your techs to be able to run any new systems, or upgraded ones.?

Siemens did a Customer Development Session with MultiCare Health Systems, which has five hospitals south of Seattle, a medical group of 400 physicians and which partners with three radiology groups. ?We looked at equipment utilization and econometrics of demand for services and worked together to see what is needed,? said Sapienza. ?Now we have monthly conversations that are not about Siemens trying to sell us things, but what are the needs and what are the solutions that Siemens can offer.

?A good example,? Sapienza continued ?is with CT and MRI. The machines are workhorses and as long as you maintain them well and update components, the core guts of the machines can last a long time without having to swap in a whole new machine. Our health system can no longer sustain changing machines every five years.? He added that the conversations are also about whether all the various systems are being utilized in a cost-effective way.

Duffy said the program is a win-win. Customers are retained with smart evaluations and when new equipment is needed, Siemens has solutions at hand. By using some optimizing techniques, MultiCare has been able to save money on replacement costs. ?Plus the conversations we?ve been having for the past few years, we?ve been anticipating now what?s happening in health care reform now,? Sapienza. ?Instead of billing on volume, we are billing for value.?

?Everybody talks about asset management these days,? Duffy opined, ?but we are really doing it.?

Getco eyes $1.4 billion deal with Knight Capital

(Reuters) - Getco Holding Co proposed a $1.4 billion deal that would see it merge into Knight Capital Group Inc , while Virtu Financial LLC offered to buy Knight for at least $1.1 billion, according to sources familiar with the situation on Wednesday.

The main attraction for Getco and Virtu, both trading firms, is Knight's U.S. market-making business, which uses computer models to match buy and sell orders in stocks and options and executes around 10 percent of U.S. equity trading volume.

But the approach of the two firms to a deal with Knight differ, and it remained unclear which - if any - would be able to clinch a deal. Knight's shares were up 13.5 percent in afternoon trading on the New York Stock Exchange.

Getco's proposal effectively would see it bought by Knight, while Getco's management, led by Chief Executive Daniel Coleman, would take control of the combined firm. The combined firm would be publicly traded, which would allow General Atlantic, which invested in Getco in 2007, to take the firm public. Getco also already has a 23.8 percent stake in Knight.

Getco's cash and stock deal would value the combined company at $3.50 per share, according to a regulatory filing and sources close to Getco. That is a 41 percent premium over Knight's closing price on November 23, the day before rumors of possible offers for Knight appeared in news reports.

Virtu offered to take Knight private for at least $3 a share in cash and take it private, a source with knowledge of the offer said. Virtu would look to sell off Knight's businesses other than market-making.

Private equity firm Silver Lake, an investor in Virtu, would be a backer of such a deal, along with other unnamed investors, the source said.

Knight makes markets and trades in more than 19,000 U.S. equities. For the first nine month of 2012, Knight's U.S. market-making unit traded an average of 3 billion shares a day.

Besides being a market maker, Knight runs bond and foreign exchange trading platforms and owns a reverse mortgage lender. It also holds a stake of about 20 percent in Direct Edge, the No. 4 U.S. cash equities exchange.

Knight acknowledged receiving Getco's offer but did not comment further.

The bidding for Knight comes months after the firm had to be rescued over the summer by Getco and other investors. It suffered a trading loss of $440 million in August due to a software glitch that unleashed a flood of orders to the New York Stock Exchange.

The rescue was led by Jefferies Group , and also included Blackstone Group LP , Stephens Inc and financial services companies TD Ameritrade Holding Corp and Stifel Financial .

As part of the deal, General Atlantic, Blackstone and TD Ameritrade, were given seats on Knight's board.

GETCO OFFER

Chicago-based Getco, the No. 2 designated market maker at the New York Stock Exchange with more than 850 listing assignments, disclosed its offer in a filing with the U.S. Securities and Exchange Commission on Wednesday. The filing included an offer letter to Knight directors.

Getco is proposing a two-step deal. The first step would involve Knight buying Getco in exchange for 242 million newly issued shares and warrants, with different strike prices, to buy an additional 69 million shares.

In the second step, the combined entity would launch a tender offer to buy up to 154 million shares at a cash price of $3.50 per share. Getco and its former owners would not participate in the tender offer.

The deal would leave the new company with more debt. Getco said it has lined up $950 million of fully committed financing from a "large financial institution."

Knight CEO Tom Joyce would become chairman of the board under the terms of the proposed deal. The Getco proposal also calls for four directors of the new company to be nominated by Getco shareholders. Sources said Getco is ready to proceed with the deal as early as December 3.

Knight shares were up 40 cents to $3.37 in afternoon trading on the New York Stock Exchange.

ROME (AP) ? A freak tornado struck a steel plant in southern Italy on Wednesday just days after its owners announced their intention to close what is Europe's largest steel facility.

One person was reported missing and some two dozen were injured when the tornado struck Wednesday, the ANSA news agency said, adding that the Ilva plant sustained significant damage.

The owners of the plant, which is a mainstay of the economy in the Taranto region, said Monday they would close the plant, a blow to government efforts to keep its 12,000 employees working while managers address health concerns amid reports of an elevated incidence of cancer in the area.

The announcement came after police, acting on prosecutors' warrants, sequestered recent steel products bound for the market. Ilva said the seizure violated the government's authorization to continue operations while it deals with the environmental issues, and said it would make it impossible to sell its products.

The plant's operators have said toxic fumes have been reduced, and the Environment Ministry has been overseeing efforts to clean up the plant and assess health risks.

Workers stormed the plant on Tuesday to protest the planned closure, the date of which hasn't been decided.

Premier Mario Monti plans to meet with plant executives Thursday to discuss the situation.

Female military members sue to serve in combat

SAN FRANCISCO (AP) ? Four female service members filed a lawsuit Tuesday challenging the Pentagon's ban on women serving in combat, hoping the move will add pressure to drop the policy just as officials are gauging the effect that lifting the prohibition will have on morale.

The lawsuit, filed in federal court in San Francisco, is the second one this year over the 1994 rule that bars women from being assigned to ground combat units, which are smaller and considered more dangerous since they are often in battle for longer periods.

The legal effort comes less than a year after the ban on gays serving openly was lifted and as officials are surveying Marines about whether women would be a distraction in ground combat units.

"I'm trying to get rid of the ban with a sharp poke," said U.S. Army Staff Sgt. Jennifer Hunt, who was among the plaintiffs in the latest lawsuit and was injured in 2007 when her Humvee ran over an improvised explosive device in Iraq.

Hunt and the other three women said the policy unfairly blocks them from promotions and other advancements open to men in combat. Three of the women are in the reserves. A fourth, Marine Corp Lt. Colleen Farrell, leaves active duty this week.

Women comprise 14 percent of the 1.4 million active military personnel. The lawsuit alleges that women are barred from 238,000 positions across the Armed Forces.

At a Washington, D.C., news conference, Pentagon press secretary George Little said the Defense Department was making strides in allowing more women into combat. He said Defense Secretary Leon Panetta has opened about 14,500 combat positions to women.

"And he has directed the services to explore the possibility of opening additional roles for women in the military," Little said. "His record is very strong on this issue."

American Civil Liberties Union Ariela Migdal, who represents the four women, said Panetta's actions weren't enough. She called for an end to the combat ban. "These tweaks and minor changes on the margins do a disservice to all the women who serve," she said.

"It falls short," she said. "It is not enough."

Marine Corps Capt. Zoe Bedell said she left active duty, in large part, because of the combat exclusion policy. Bedell said she was frustrated that her advancement in the Marines was blocked by her inability to serve directly in combat units.

"The military is the last place where you are allowed to be discriminated against because of you gender," she said.

Bedell said the blurred front lines of modern warfare, with suicide bombs and sniper attacks, have put more and more women in combat situations.

More than 144 female troops have been killed and more than 860 have been wounded in Iraq and Afghanistan since the wars began, according to Pentagon statistics.

Military leaders say they want to make sure lifting gender-based barriers would not disrupt the cohesion of the smaller combat ground units and military operations.

The Marine Corps' top leader, Gen. James Amos, ordered a survey of 53,000 troops to get their views, including whether they believe women in those units would distract male Marines from doing their jobs. The results have not been released yet.

The lawsuit alleges the ban violates constitutional female service members' equal rights. "As a direct result of this policy," the lawsuit states, "women ? as a class and solely because of their gender ? are barred from entire career fields.

The lawsuit also alleges that women are already serving unofficially in combat units.

Air National Guard Major Mary Jennings Hegar sustained shrapnel wounds in 2009 when she exchanged fire on the ground in Afghanistan after her Medevac helicopter was shot down. Both she and Hunt received Purple Heart medals for their injuries.

The lawsuit was assigned to U.S. District Judge Edward Chen, an appointee of President Barack Obama.

Shopping malls cater to shifting demographics

NEW YORK (Reuters) - Macerich Co isn't usually in the business of hosting religious processions in its mall parking lots.

But when it allowed a Good Friday event featuring a costumed Jesus, prisoners and Roman guards at a Phoenix mall last year, hundreds of shoppers turned out from the heavily Hispanic community, where re-enactments of the Stations of the Cross are a major occasion.

The response proved to Macerich that its program to attract the surrounding population to its malls was working.

A small but growing number of real estate owners and developers are tapping into the same demographic change U.S. politicians have begun to recognize.

Two ethnic groups - Hispanics and Asian-Americans - are expected to see their population and buying power soar in the coming years. And several demographic experts project that non-Hispanic whites will be a minority nationally by 2040 or 2050.

If mall and shopping center owners fail to adapt to the changing demographic make-up of the country, they risk seeing their properties become mausoleums of a less-diverse American past.

"It's a bunch of guys trying to build for a (white) world that's no longer growing. But there are those individuals out there that are seeing the growth in different ways. They're picking it apart and making some big money off of it," said James Chung, president of strategy and research firm Reach Advisors.

Many developers focusing on ethnic shoppers have come to the rescue of dying malls and shopping centers throughout the United States.

In California, Primestor Development is transforming the 850,000-square-foot Baldwin Hill Crenshaw Plaza in Los Angeles into an Hispanic-focused mall, plowing in up to $40 million for renovations. Further south in Irvine, Diamond Development Group has created Diamond Jamboree, with small service-oriented tenants, such as doctors' offices, anchored by an Asian food market. In Atlanta, a vacant 220,000-square-foot furniture store has been converted into Global Mall, the largest U.S. mall targeting consumers whose roots are in southern India.

DESERT SKY BRIGHTENS

Macerich is in the forefront of large, publicly traded mall owners courting the growing numbers of ethnic shoppers. Two years ago it teamed up with Legaspi Co, a consultant and operator of Hispanic-oriented malls, to help Desert Sky Mall. Occupancy at the Phoenix mall had fallen to 77 percent from over 90 percent as the demographic make-up of its trade area shifted.

Several changes were made, including converting a vacant Mervyns store into a mercado - Spanish for market - with scores of small shops and stands. Occupancy at the mall is now back up to 90 percent.

With the success of Desert Sky, Macerich and Legaspi Co President Jos? de Jes?s Legaspi created Vanguardia, a program that includes marketing and renovations to transform malls before their occupancy suffers.

"We aren't about to let good real estate go that way," Macerich Executive Vice President Eric Salo said.

Jos? de Jes?s Legaspi started more than 30 years ago helping retailers reach Hispanic shoppers. His company operates or has a stake in four malls and is eyeing a 700,000-square-foot mall in Oklahoma City.

Transforming struggling malls has a lot to do with marketing, including using bilingual staff, sending out direct mail in both English and Spanish, and hosting events like Mexican Independence Day.

MORE THAN DIM SUM AND CHIMICHANGAS

When building its Asian-focused, grocery-anchored shopping centers, Diamond Development followed the engineering workforce, which includes a heavy concentration of Asians. It found that restaurants were in demand, and leases had to include clauses prohibiting restaurants from copying each other's specialties.

But it takes more than adding a dim sum restaurant or chimichangas to the food court to attract the growing U.S. Hispanic and Asian populations.

Primestor, which has built or redeveloped more than 80 Hispanic-focused malls, shopping centers and strip malls, uses research from Pew Hispanic Center and the U.S. Census, and conducts town hall meetings to discover the types of retailers an area lacks and to gauge demand.

"We're not in the build-it-and-they-will-come mentality," said Arturo Sneider, Primestor's chief executive. "We're in the build-it-improve-it-because-they're-already-here mentality."

Developers of malls and shopping centers aimed at Hispanic Americans say they often change the facilities' physical appearance, transforming dull, fortress-like malls into festive, colorful shopping centers. Because Latino families tend to be larger, developers broaden the corridors and make common areas bigger; because such families tend to be younger, there is more demand for shoe and clothing stores - for growing children.

Third-generation Hispanic Americans add another consideration. Like the American mainstream, they want the latest consumer electronics and tend to like restaurants, such as Chipotle Mexican Grill, that are popular with their mainstream peers, Sneider said.

NO SUCH THING AS A CHINESE TIE

But what works for some ethnic groups doesn't necessarily work for others. Seoul Plaza, a Korean marketplace billed as a "mall within a mall" in Baltimore's Security Square Mall, did not fare well in competition with other Asian markets in the area. Many stores closed, and the plaza has been up for sale since 2010.

In targeting Asian-American shoppers, merchants selling soft goods such as clothing and toys tend to find the going tough, said Steve Zuckerman, project manager at Diamond Development.

"The reason for that is there's really no such thing as a Chinese necktie," Zuckerman said. "A Chinese guy, if he wants to save money, he's going to go to Ross, Walmart. If he wants to spend money, he'll go to Bloomingdale's or Nordstrom."

The Macerich-Legaspi Vanguardia program has been implemented at six of Macerich's 59 malls, and aspects of it have been employed to some degree at a few others.

"There's been enough financial success here that we're going to continue to invest in this," Macerich's Salo said. "It's good business."

Syrian rebels capture air base near Damascus

BEIRUT (AP) ? Syrian rebels captured a helicopter base just outside Damascus Sunday in what an activist called a "blow to the morale of the regime" near President Bashar Assad's seat of power.

The takeover claim showed how rebels are advancing in the area of the capital, though they are badly outgunned, making inroads where Assad's power was once unchallenged. Rebels have also been able to fire mortar rounds into Damascus recently.

The director of the Britain-based Syrian Observatory for Human Rights, Rami Abdul-Rahman, said rebels seized control of the Marj al-Sultan base on the outskirts of Damascus on Sunday morning. He said at least 15 rebels and eight soldiers were killed in the fighting that started a day earlier. The rebels later withdrew from the base.

Rebels appear to be trying to take over air bases and destroy aircraft in order to prevent the regime from using them in attacks against opposition forces around the country.

The rebels have no protection against the attack helicopters and fighter jets that have been blasting their positions.

Rebels have been attacking air bases in different parts of Syria, mostly in the northern regions of Idlib and Aleppo.

In the battle at the base outside Damascus, Abdul-Rahman and Damascus-based activist Maath al-Shami said rebels destroyed two helicopters with rocket propelled grenades and captured a tank. They say the base, which is on the eastern outskirts of Damascus, houses several radar positions.

"This is a blow to the morale of the regime, because it is close to the heart of the capital," said Abdul-Rahman, referring to the base that is about 15 kilometers (10 miles) from Damascus.

Al-Shami said the rebels withdrew from the base after they captured some ammunition. He said they feared counterstrikes by regime aircraft.

An amateur video posted online showed rebels walking next to two destroyed helicopters. At least three other helicopters appeared undamaged. Black smoke billowed in the distance.

Another video showed several radar posts on hills inside the large compound. Parked military trucks stood inside as rebels roamed freely.

The activist videos appeared genuine and corresponded to other AP reporting about the events depicted. Syria restricts the access of reporters.

The Observatory also reported violence in other parts of Syria, including the country's largest city of Aleppo in the north and the capital itself.

The Local Coordination Committees, another activist group, said residents found 12 bodies in the Damascus suburb of Daraya, scene of heavy clashes between rebels and government troops over the past few days.

State TV said troops clashed with al-Qaida militants in Daraya, killing some of them and confiscating a mortar that they were using in their attacks.

Assad's regime blames the revolt on a foreign conspiracy. It accuses Saudi Arabia and Qatar, along with the United States, other Western countries and Turkey, of funding, training and arming the rebels, whom it calls terrorists.

Syria's conflict erupted in March 2011 with an uprising against President Bashar Assad's regime, inspired by other Arab Spring revolts. It quickly morphed into a civil war that has since killed more than 40,000 people, according to activists.

The Untold Stories: International law, The M23 Insurgency, and ...

The M23?s latest assault on Goma has an international legal consequence and constitutes a set of war crimes. The large-scale military assault launched by M23 on Goma, and the manner in which both Rwanda and M23 forces are fighting this war, raise numerous red flags regarding large scale violations of human rights and international humanitarian law (IHL). Such violations have long characterised the international legal framework in armed conflict; yet despite post-Cold War improvements in the enforceability of international criminal law, in the Congo context those who perpetrate human rights violations and war crimes seem largely immune to legal accountability.
The indictment of the Congo War Lord commonly known as Terminator has proved disastrous and difficult to enforce and the current UN Security Council sanctions against the M23 rebel leader Sultan Makenga is likely to suffer the same fate, yet the Rwandan leaders who have been supporting these conflicts in Congo for almost 2 decades seem not bothered by the continued death of innocent people. The International Community with the largest UN Peace keeping force in the world stationed in Congo, just looked on as the M23 forces matched into Goma without any resistance.
Certainly, international law offers no panacea for the death and destruction of war; nor does most media coverage of the Congo conflict devote more than the scantiest attention to the human rights implications of such violence. International law does, however, provide the most important standard against which the conduct of opposing sides can be judged. Such judgments have political currency, if not during the heat of battle then later. International human rights campaigner Raji Sourani described it in the midst of the current violence, human rights is the ?skin? to protect civilians from the all-out aggression of those who attack them.
International law impacts the present war in Congo in two key ways. One pertains to whether the violence deployed by each side complies with or violates IHL, in particular the Geneva Conventions of 1949 and their Additional Protocol I of 1977. The other, more complicated issue pertains to the assistance the Rwandan government is giving the rebel group M23.
Since the 1996 Rwanda has been involved directly or indirectly in the destabilization of Congo. Rwanda has been denying or giving vague excuses .However, the International Committee of the Red Cross, the official guardian and authoritative interpreter of IHL, has consistently maintained that the Fourth Geneva Convention will be applicable to countries or individuals who support not only rebels but rather all activities that result in the crimes against humanity. This view is endorsed by a vast preponderance of international legal opinion, including United Nations resolutions and the opinion of the International Court of Justice.
Rwanda under Kagame for his personal economic reasons also advances the novel interpretations of IHL in order to project the legitimacy of dubiously legal or patently unlawful practices in his involvement in Congo by arguing that Congo harbors the former militias who committed genocide in Rwanda in 1994. Rwanda?s consistent position over almost 2 decades that Congo harbors militias and as such, Rwanda has to go to Congo any time its coffers are dry, does not hold any legal water in the glass.
This extends to the interpretation that Rwanda?s own conduct is not tightly regulated by IHL when engaged in a war against what they call militias and sometimes terrorists. However, the Geneva Conventions are considered customary international law, and therefore apply any time and place and on any parties who use armed force to wage war on enemies.
The fundamental purpose of IHL is to protect civilians and minimize avoidable harm during armed conflicts. Under IHL, five core principles govern what conduct is lawful in armed conflict. Violations of these constitute grave breaches and thus can be considered war crimes. These principles are: civilian immunity (ie, the prohibition against intentionally targeting civilians or otherwise treating them as combatants); distinction (i.e., the imperative to distinguish between civilians and combatants in military operations, and for combatants to distinguish themselves as such through identifiable dress and insignia and by carrying arms openly); proportionality (ie, the requirement to use force in a manner that is proportionate to the military value of the target); necessity (ie, the obligation to restrict targets or tactics to those necessary to achieve legitimate military goals); and humane treatment (ie, the prohibition of torture, inhumane and degrading treatment of prisoners, and the imperative to guard the rights and interests of ?protected persons?, the legal term for civilians in captured territories)..
Unfortunately, there has been violation of these entire international legal obligations by the rebels in the territory they have captured. Reports have indicated massive killings, abductions of civilians, rape of women and disappearances. Ultimately, no matter how much Rwanda wants to use Rwanda militias in Congo as the political, legal and moral interference in the Congo affairs, its actions and legacy, are not far from those of other states which systematically use violence against civilians. This will be determined by its adherence to or violations of normative interpretations of international law. The longer Rwanda under Kagame continues to kill Congolese directly or by his rebel proxy M23 indiscriminately and with impunity, and the longer it maintains the military and financial illegal support of this notorious rebel group, the more such policies will face greater de-legitimation and opprobrium.

Health Insurance Exchanges May Be Too Small to Succeed

With the re-election of President Obama, the Affordable Care Act is back
on track for being carried out in 2014. Central to its success will be
the creation of health-insurance exchanges in each state. Beneficiaries
will be able to go to a Web site and shop for health insurance, with the
government subsidizing the premiums of those whose qualify. By
encouraging competition among insurers in an open marketplace, the
health care law aims to wring some savings out of the insurance industry
to keep premiums affordable.

Certainly, it is hard to be against competition. Economic theory is
clear about its indispensable benefits. But not all health care markets
are composed of rational, well-informed buyers and sellers engaged in
commerce. Some have a limited number of service providers; in others,
patients are not well informed about the services they are buying; and
in still others, the quality of the service offerings vary from provider
to provider. So the question is: What effect does insurer competition
have in a marketplace with so many imperfections?

The evidence is mixed, but some of it points to a counterintuitive
result: more competition among insurers may lead to higher
reimbursements and health care spending, particularly when the provider
market ? physicians, hospitals, pharmaceuticals and medical device
suppliers ? is not very competitive.

In imperfect health care markets, competition can be counterproductive.
The larger an insurer's share of the market, the more aggressively it
can negotiate prices with providers, hospitals and drug manufacturers.
Smaller hospitals and provider groups, known as "price takers" by
economists, either accept the big insurer's reimbursement rates or forgo
the opportunity to offer competing services. The monopsony power of a
single or a few large insurers can thus lead to lower prices. For
example, Glenn Melnick and Vivian Wu have shown that hospital prices in
markets with the most powerful insurers are 12 percent lower than in
more competitive insurance markets.

So health insurance exchanges are probably welcome news for hospitals,
physicians, and pharmaceutical and medical device companies throughout
the United States. If health insurance exchanges divide up the market
among many insurers, thereby diluting their power, reimbursement rates
may actually increase, which could lead to higher premiums for consumers.

There is some evidence on how insurer market power affects premiums.
Leemore Dafny, Mark Duggan, and Subramaniam Ramanarayanan have found
that greater concentration resulting from an insurance merger is
associated with a modest increase in premiums ? suggesting that
concentration may not help consumers so much ? although they did report
a reduction in physician earnings on average. Over all, however, the
evidence is limited and mixed.

Greater competition in the insurance industry ? either through health
insurance exchanges or other measures ? may not lower insurance
premiums. Weakening insurers' bargaining power could instead translate
into higher costs for all of us in the form of higher premiums.

In financial markets, we ask if banks are too big to fail. When it comes
to health care, perhaps we should ask if insurers are too small to succeed.

It is true that very large insurers within the exchanges can use their
monopsony power (controlling the market as exclusive buyers) by
demanding lower prices for health care services, but only for their own
plans. Most health care costs will still be covered by
employer-sponsored plans, Medicare, Medicaid and other programs. Thus
plans offered by the exchanges cannot have much impact on our total
national health expenditures.

Another difficulty with the monopsony power of private insurers is that
when they are investor owned (WellPoint, UnitedHealth, Aetna, etc.),
their first priority must be to use their leverage to benefit their
investors. That results in insurance innovations that often are not
particularly transparent, but have adverse consequences for the patients
they insure. The private sector exercising power as a monopsony can be
as evil as a monopoly.

In contrast, a public monopsony can be very beneficial in getting prices
right - high enough to ensure adequate capacity in the delivery system,
yet low enough to ensure value in health care.

The ultimate beneficent monopsony would be a single public program
covering absolutely everyone ("single payer"). We could achieve this
easily by improving Medicare and then making it universal. Health policy
studies have proven that this would not only cover everyone, but it
would finally bring us that elusive goal of health care reform - bending
the cost curve to sustainable levels.
